Rajasthan Rent Control Act, 2001–Sec. 19-A–Application under–Dismissed–Justification–Eviction proceedings u/s. 9–Petitioner filed the application u/s. 19A with seeking the direction for payment of monthly rent during the pendency of proceedings–Findings of Court below that the application can be decided while deciding the issue of land-lord and tenant relation ship–Application was required to be considered independently and same was not dependent on the issues framed between the parties–Otherwise, the very purpose of Sec. 19A will be frustrated–False plea taken by the tenant can not be considered to deny the payment of rent during the pendency of proceedings–Further, the conduct of the respondent is found avoiding the summons–He is directed to pay the arrears of rent.
