Rajasthan Minor Minerals Concession Rules, 2017–Rules 28(x) & 86–Cancellation of quary licence for non-deposit of lease rent–Justification–Notice was sent at incomplete address and it was returned by the Postal Department with the endorsement “address is incomplete”–Notice was not effectively served on the petitioner and, therefore, the mandatory requirement of serving 30 days notice before termination of licence was not complied with–Futher, the Appellate Authority passed a wholly cryptic and non-speaking order–A statutory appeal must involve due consideration of the grounds urged and proper decision supported by reasons–Both the orders are in violation of mandatory provisions of Rules of 2017–Set aside and restored the licence.
