Penal Code, 1860–Secs. 21–Clause Thirteen–Code of Criminal Procedure, 1973–Sec.197–Petitioner nos. 3 & 4 were the labourers engaged by the Gram Panchayat for removal of unauthorised construction–Held, they are protected u/s. 21 of I.P.C. and prosecution sanction u/s. 197 Cr.P.C. was required for prosecuting them–Proceedings against them are liable to be quashed.
