Penal Code, 1860–Secs. 302, 323 & 341–Conviction–Proper Section–Death was caused due to coma brought about as a result of ante-morterm head injury which was sufficient to cause death in the ordinary course of nature–Occurrence took place outside the gate of the house of deceased–Appellant R gave a stick blow on the head of deceased in the occurrence which took place in all of a sudden and in the heat of passion–He did not repeat the blow–No intention of having such bodily injury which was likely to cause death–He is liable to be convicted u/s. 304 Pt. I–Appellant B and S are liable to be convicted u/s. 341.
