Code of Civil Procedure, 1808–Order 6, Rule 17–Specific Relief Act, 1963–Sec. 21(5), proviso–Suit for specific performance–If the land is acquired during the pendency of the suit or appeal, the application u/s. 21(5) would be maintainable to seek compensation–In the instant case, application was for compensation arising out of acquisition as the land was acquired during the pendency of suit–Held, it was rightly allowed.
