Industrial Disputes Act, 1947–Sec. 33(2)(b)–Whether on the basis of the judgment of acquittal in a criminal case, a person is entitled to automatic reinstatement in service or not ?–Held, in a case where inquiry has been held independently of the criminal proceedings, acquittal in a criminal case is of no help–Even if a person stood acquitted by a Criminal Court, domestic enquiry can be held, the reason being that the standards of proof required in a domestic inquiry and that in a criminal case, are altogether different–The rules of evidence which apply to a criminal trial are distinct from those which govern a disciplinary inquiry.
