Bharatiya Nagarik Suraksha Sanhita, 2023–Sec. 430 [Corresponding Sec. 389 of Cr.P.C., 1973]–Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 8/15–Suspension of the sentence–Quantity of the recovered contraband is demarcated the commercial quantity–There is a submission regarding non-compliance of the mandatory provisions of the Act–The embargo contained u/s. 37 of the Act would not come in the way of granting the bail to the appellant–All the issues are vital in nature and carry sufficient force and substance such that if they are adjudicated in favour of the appellant, the possibility of acquittal cannot be ruled out–Application deserves to be allowed.
