Drugs & Cosmetics Act, 1940–Secs. 25(4), 18(A)(i), 16(1)(A) r/w. 17A(F)(i), 17B(D), 18 & 27–Order of taking cognizance–Sample was taken on 13.12.2007 where as the complaint was filed on 28.5.2014–Drugs expired in May 2009 & August 2010–However, the petitioners were informed on 13.4.2009 i.e. before expiry dates of samples–Case of drugs being sub-standard–Held, no interference is required in the impugned order of taking cognizance.
