Permanent Injunction & Declaration –Suit for–Dismissal–Allegation of construction after encroachment over the road–This Court directed to District Collelctor to conduct a fresh site inspection of the disputed premises–As per site report, the disputed building was constructed in conformity with the approved plan, leaving 30 feet of land towards the western side as required by the UIT–Findings of Trial Court are not in conformity with the oral and documentary evidence on record–Impugned judgments set aside and directed to the respondents for not making any interference with the peaceful possession of the appellant.
