Partition–Right of–Right to partition is continuous and a recurring right and cannot be lost by mere non-exercise of it–However, any question of right or title, which might have been finally decided in earlier suit, cannot be allowed to be respond in second suit except perhaps where a case of fraud or the like, may be alleged and proved.
