Partition–Shop in question was purchased by defendant B in public auction–Price was adjusted from the firm and property was purchased in his name as he was the senior partner of firm–His plea that the amount was debited in his account, cannot be accepted because he failed to produce the account books and there are ample evidence on record to show that the books were in his possession.
