Code of Criminal Procedure, 1973–Secs. 190, 200 & 202 [ Corresponding Secs. 210, 223 & 225 of BNSS, 2023]–Scope for taking the cognizance on the negative final report–Magistrate is required to follow the provisions of Sec. 200 & 202–The Magistrate’s failure to comply with these provisions including not recording statements of the complainant and witnesses, and mechanically taking cognizance despite the negative final report would be a grave irreguarity.
