Penal Code, 1860–Sec. 306 [Corresponding Sec. 108 of BNS, 2023]–Criminal proceedings–Sustainability–The charge-sheet, as it stands, appears to have proceeded in a unidimensional manner by accepting the version of the complainant and his family members as the gospel truth–It was not investigated that even if it was suicide, what was the real cause, was the deceased distraught with what happened to her friends, was there any instigation for the suicide from any other quarter ?–None of the ingredients required in law to make out a case u/s. 306 to be even remotely mentioned in the charge-sheet–Proceedings with the trial against the appellants in the charge-sheet as filed will be a gross abuse of process–Quashed with certain directions.
