Code of Civil Procedure, 1908–Order 7, Rule 11–Rajasthan Apartment Ownership Act, 2015–Application for rejection of plaint–Dismissal of–Justification–Suit for declaration and permanent injunction in regard to discontinuation of the facilities to the plaintiff in the society–Facts narrated in plaint clearly indicate that a resident welfare society was already created for the society developed by the petitioner-defendant–Plaintiff filed the civil suit without approaching the Competent Authority as provided under the Act of 2015–Civil suit is not maintainable before the Civil Court and same is barred u/s. 31 of the Act–Application deserves to be allowed.
