Bharatiya Nagarik Suraksha Sanhita, 2023–Sec. 94 [Corresponding Sec. 91 of Cr.P.C., 1973]–Rajection of the application–Justification–Maintenance proceedings–Specific allegation by the petitioner-husband that the wife is employed in a private hospital and she has not disclosed this fact–He is seeking the documents of service and income of the complainant-wife, which is undoubtedly a material factor for adjudication–Since the hospital in question is a private institution and has declined to furnish the information, the provisions of Sec. 94, BNSS are clearly attracted–Application deserves to be allowed.
