Code of Civil Procedure, 1908–Sec. 9–Scope–Court shall have jurisdiction to try all suits of a civil nature except suit of which cognizance is expressly or impliedly barred–Consent of parties cannot confer nor take away the jurisdiction of any Court which means if a civil Court has jurisdiction neither acquiescence nor waiver or estoppel can create the same–Plantiffs have not filed a civil suit in accordance with provisions either under the designs Act or under the Copyright Act.
