Rajasthan Public Trust Act, 1959–Sec. 38–Constitution of India, 1950–Art. 226/227–Order passed by the Assistant Commissioner–Writ petition against the order–Maintainability–Assistant Commissioner kept the issue of the elections and the tenure to be decided in another case but granted the permission to the private respondent to file the civil suit against the trust only to the extent to adjudicating the allegations of mismanagement of the trust–Present writ petition has been filed by the petitioner in individual capacity challenging the order–It is not maintainable and the petitioner has no locus standi to question the impugned order–Further held, the suit has been instituted only against the Trust, therefore, the present writ petition is not maintainable without impleading the trust as a necessary party–Petition deserves to be dismissed.
