Code of Civil Procedure, 1908–Order 6, Rule 17–Order of allowing of the application–Under challenge–Suit was at the preliminary stage and the application had been filed at the very inception–Permitted amendment makes it clear that the relief prayed pertains to the same property and the parties to the dispute are also same–Objection as regard to notice u/s. 304 of the Rajasthan Municipal Act, can be raised only by the Municipal Authorities and not by the private parties–No case is made out for interference.
