Code of Criminal Procedure, 1973–Sec. 167(2(a)(i)–Right to get the default bail–Petitioner was arrested for the offence u/s. 363 and he was granted the bail on the next day–Thereafter, he was re-arrested upon fresh inclusion of the offences u/ss. 457, 342, 366A, 376(2)(n), 376(D) and u/ss. 3/4, 5(g)/6 POCSO Act–The period of 90 days would attract when the investigation with regard to these particular offences beguin–The charge sheet was rightly filed within 90 days.
