Representation of People Act, 1951–Secs. 81, 83 & 86–Conduct of Election Rules, 1961–Rule 94-A–Code of Civil Procedure, 1908–Order 7, Rule 11–Election petition was held non-maintainable as it was not supported by an affidavit in Form No. 25 as prescribed under Rule 94-A–This was a curable defect and the election petitioner was to given the opportunity to file an affidavit in support of the petition in Form 25 in addition to the already existing affidavit filed with the election petition–Impugned order set aside and the appellant is given the liberty to file the appropriate affidavit.
