Motor Vehicles Act, 1988–Sec. 147–Situation where the third party insurance policy had been cancelled for the reason of bouncing of the cheque of premium and the Insurance Company had intimated to onwer and RTO before the date of accident–Insurance Company has paid 50% amount to the claimants–Recovery of such amount from the claimants would be not only harsh but also would amount to setting the clock back–Held, Insurance Company is given liberty to recover this amount from the owner–Further held, claimants are entitled to recover the remaining 50% amount from the owner of offending vehicle.
