Criminal Trial–Clean acquittal or benefit of the doubt–In the instant case, prosecution evidence was completely absent–There was no reason for applying the principle of benefit of the doubt–Moreover, all the prosecution witnesses turned hostile and there was no prosecutorial basis for the charge–Trial Court was under the obligation to record the clean and honorable acquittal–Impugned judgment deserves to be modified accordingly.
