Essential Commodities Act, 1955–Sec. 6A–Rajasthan Trade Articles (Licensing and Control) Order, 1980–Order of confiscation of stock of grams–Set aside by the Sessions Court–Appreciation of–Proceedings for seizure were carried out on 01.11.2015 whereas, the amendment in the Order, 1980 was published in Official Gazette on 20.10.2015–Respondent-firm was entitled to seek the licence for the grams to be stored at its ware house till 15 days from the date of order dated 20.10.2015–Findings recorded by the Sessions Judge are justified–Further held, District Judge is the appellate authority as prescribed u/s. 6C of E.C.Act–Interference declined.
