Penal Code, 1860–Sec. 494–Code of Criminal Procedure, 1973–Sec. 418(1), Proviso–Sentence of imprisonment till rising of the Court–Admissibility–The proviso to Sec. 418(1) Cr.P.C. together with the penal provision u/s. 494 IPC, prescribes no minimum imprisonment but only the maximum would definitely make imposition of imprisonment till the rising of the Court intra vires.
