Rajasthan Court Fees & Suit Valuation Act, 1961–Secs. 45 & 37–Code of Civil Procedure, 1908–Order 7, Rule 11–Suit with seeking the administration of the estate of deceased in terms of his Will–Court fees is to be levied on the plaint at the rates as specified in Sec. 45, and in turn, Sec. 45 clearly provides that where the valuation of the subject matter in dispute exceeds Rs. 10,000/- fixed Court fees of Rs. 300/- is required to be paid–Plea as regard to deficient Court fees has no substance.
