Penal Code, 1860–Secs. 302/149, 307/149, 147 & 148 [Corresponding Secs. 103/190, 109/190, 191(2) & 191(3) of BNS, 2023]–Acquittal from the offence by giving the benefit of doubt–Appreciation–Five accused were convicted while the present eight respondents were acquitted–Sudden altercation and fight between the parties–No specific role has been attributed to the acquitted respondents except the general allegation that they were present at the spot and had brutally assaulted the injured and the deceased–It is not established that the respondents had come to the place of occurrence with any premeditated intention to cause bodily injury or death–Even if existence of an unlawful assembly is accepted, the same would not be sufficient for convicting the respondents–Trial Court has examined each and every aspect of the matter–Interference declined.
