Maintenance and Welfare of Parents & Senior Citizens Rules, 2010–Rule 20–Whether the maintenance Tribunal (SDM) is competent to pass the order of eviction ?–Held, no–Even by over-stretching the scope of Rule 20, if the power of eviction is read into the Rules of 2010, the powers of passing an order of eviction can be exercised by the District Magistrate or its subordinate and in no case by the Tribunal–An SDO may be administratively subordinate to the District Magistrate but while discharging the duties as a persona designata, the Presiding Officer of the Tribunal does not act as a subordinate of the District Magistrate in any manner.
