Code of Criminal Procedure, 1973–Sec. 235–Scope–Discretion has been given to a judicial officer to extend the benefit of probation to a guilty person after hearing him on the question of the sentence–While hearing on the point of sentence, a judicial officer can take into account the circumstances of the case, the circumstances of the accused his social and economical background, his age and character and antecedents.
