Code of Civil Procedure, 1908–Order 7, Rule 11–Rajasthan Tenancy Act, 1955–Secs. 207, 88 & 188–Scope–Where the khatedari rights are yet to be determined/declared, a party has to first approach the Revenue Court for declaration/determination of the khatedari rights–Revenue suit preferred by the plaintiffs has been dismissed and appeal against the judgment is pending adjudication–Meaning thereby, no khatedari rights of plaintiffs have been declared/determined till date–Suit for cancellation of sale deed is not maintainable before the Civil Court and plaint is liable to be rejected.
