Penal Code, 1860–Secs. 302, 201 & 203–Conviction–Sustainability–Death was occurred due to consuming ethyl alcohol and organo chlorine–Prosecution failed to establish the fact that these contents were found in the pesticide purchased by appellant–Further, no evidence on record to show that the appellant purchased the said pesticide–Witnesses of recoveries turned hostile–Prosecution could not be established beyond doubt–Held, the appellant is entitled to be acquitted.
