Rajasthan Court Fees & Suit Valuation Act, 1961–Determination of Court Fees–Relevant factors–It is the nature of relief claimed which becomes the basis for the valuation of a suit–The market value of any property cannot be a decisive factor for valuation of the suit–In the instant case, the second agreement was executed for sale of eight plots on the consideration amount of Rs. 23 lakh even the possession for only these plots has been prayed for–No relief qua the 22 plots or for amount of Rs. 5,47,84,625/- has been prayed–Impugned order of directing to pay the deficit court fees on the consideration amount Rs. 5,47,84,625/- is liable to be quashed and set aside.
