Code of Criminal Procedure, 1973–Secs. 173 & 190–Negative final report filed by police–Disagreeing with–Options available to Magistrate–Held, Magistrate has following two option:-
(1) he may not agree with the police report and direct an inquiry u/s. 202 and after such inquiry, take action u/s. 203.
(2) he can take cognizance of u/s. 190 at once if he disagrees with the adverse police report.
