Code of Criminal Procedure, 1973–Sec. 125 [Corresponding Sec. 144 of BNSS, 2023]–Scope–Wife’s employment does not automatically disqualify her from getting maintenance–Maintenance awarded to wife is not a bounty and, therefore, unless it is established before the Family Court with cogent evidence that the wife has sufficient income to maintain herself, the prayer for interim maintenance cannot be denied.
