Code of Criminal Procedure, 1973–Sec. 340 [Corresponding Sec. 379 of BNSS, 2023]–Nature of proceedings–Initiation of proceedings u/s. 340 Cr.P.C. is discretionary and not mandatory–The Court is not bound to make a complaint in every case, and the discretion is to be exercised only when it is expedient in the interests of justice to do so–The expediency has to be ascertained on the basis of the impact which is caused upon the administration of justice.
