Motor Vehicles Act, 1988–Sec. 173–Code of Civil Procedure, 1908–Order 41, Rule 22(4)–Scope for dismissing the cross-objection–Even if the original appeal is withdrawn or is dismissed for default, the cross-objection would neverthless be heard and determined after such notice to the other parties as the Court thinks fit–In the instant case, even if the appeal of Insurance Company was dismissed in default and it had submitted that it was not interested to revive the appeal, still the High Court was required to decide the crossobjection of appellants herein on merits and in accordance with law.
