Insurance Claim–Repudiation–Award by Permanent Lok Adalat–Condition of submitting the claim within 30 days–Deceased was insured in group insurance policy through his kisan credit card–Premium was paid by respondent no. 2 bank–Family members of deceased may not be aware about the existence of policy–Further, the relations between the deceased and respondent no. 2 were not of employer and employee, therefore, it was difficult nay impossible for the bank to know that a particular member/kisan credit card holder has been passed away–Insurance Company did nto challenge the fact of accident–Furthermore, the accident took place on 31.01.2017 and death was occurred on 09.02.2017–Relevant date should be reckoned from the day of death–A family in which eight persons got injuries in accident, cannot be expected to search the investments of deceased and take up the proceedings to claim the benefit–Held, award passed by Lok Adalat was justifed.
