Motor Vehicles Act, 1988–Secs. 147 & 149–Libaility of Insurance Company–Breach of conditions of policy–Six persons including the driver were covered by the Insurance Policy–A larger number of persons were being carried in the vehicle–Held, the liability of Insurance Company would be confined up to six persons–Excess persons will be treated as the third party–Insurance Company would not be liable for their compensation, however, it would make the payment in respect of them and would be entitled to recover the same from the owner of the vehicle–Total amount of six awards which are the highest shall be construed as the liability of the Insurance Company.
