Railways Act, 1989–Sec. 123–Railway untoward incident–During the pendency of appeal, amendment came into effect and the statutory amount of compensation was enhanced from Rs. 4,00,000/- to Rs. 8,00,000/- –Whether the High Court was justified in awarding the amount of Rs. 8,00,000/- with 9% annual interest ?–Held, no–Amount of compensation payable on the date of accident with reasonable rate of interest shall be calculated–However, in the instant case, if the amount of original compensation alongwith reasonable interest, comes less than Rs. 8,00,000/- claimant would be entitled for Rs.
8,00,000/- and if such amount exceeds the sum Rs. 8,00,000/- compensation would be in term of figure in excess of Rs. 8,00,000/-.
