Criminal Trial–Gravity of offence–Base of conviction–Held, criminal Court should not be swayed by the gravity of the offence and proceed to hand-out the punishment on the basis–It would be violative to the basic tenants of criminal jurisprudence to do so in absence of any credible evidence.
