Limitation Act, 1963–Sec. 4–General Clauses Act, 1897–Sec. 9–Dismissal of appeal as barred by limitation–Justification–Order in original was served on the petitioner on 13.12.2022 and 12.03.2023 was Sunday–Appeals were presented on 13.03.2023–Even the appeals were found barred by one day, the authority should have granted time to appellants to make an application seeking condonation of delay–Section 4 of the Act clearly prescribes that where a prescribed period for any appeal expires on a date when the Court is closed, the suit, the appeal or application may be instituted, preferred or made on the day when the Court reopens–Appeals were in limitation–Impugned orders are liable to be quashed and set aside.
