Code of Criminal Procedure, 1973–Secs. 216 & 362 [Corresponding Secs. 239 & 403 of BNSS, 2023]–Penal Code, 1860–Sec. 307–Investigation agency submitted supplementary report qua the other involved persons–But at the same time, charge u/s. 307 was also added against the present petitioners–Earlier, the charge-sheet had been filed against the petitoners and no investigation was kept pending against them–Trial Court had applied it’s mind on the injury report and statements of witnesses while framing the charge u/ss. 498A, 406, 323 & 325/34–Impugned order of adding the charge u/s. 307 amounts to review the earlier order which cannot be sustained in eye of law–Quashed and set aside.
