Code of Criminal Procedure, 1973–Sec. 188–Penal Code, 1860–Secs. 498-A & 506–Offence committed by Indian Citizen outside of India–Proceedings–Petition of quashing before High Court for want of prosecution sanction by Central Govt.–Dismissed–Condition imposed by the proviso of Sec. 188 provides that at the stage of taking cognizance, no prosecution sanction is required, however, a trial cannot be proceeded without previous sanction–Held, proceedings cannot be quashed, however, Magistrate will not proceed with the trial without the sanction from the Central Govt.
