Code of Civil Procedure, 1908–Sec. 97–Scope–Where a party aggrieved by a preliminary decree does not appeal from it, he is precluded from disputing it’s correctness in any appeal which may be preferred from final decree–In other words, matters which are concluded by preliminary decree cannot be re-agitated in an appeal against final decree.
