Transfer fo Property Act, 1882–Sec. 52–Mohammedan Law–Whether the principle of lis pendens can be held inapplicable in Mohammedan Law ?–Held, no–Though the Sec. 2 of T.P. Act protects the rule of Mohammedan law by excluding the provisions of Secs. 5 to 53-A of T.P. Act, yet no rule is existed in Mohammedan Law containing the lis pendens–Therefore, the provisions of Sec. 52 would be applicable.
