Code of Criminal Procedure, 1973–Sec. 256–Scope–Two constraints before exercising the powers of Section–
(i) if the Court thinks that in a situation it is proper to adjourn the hearing,
(ii) if the Magistrate considers that personal attendance of the complainant is not necessary on that day, he will dispense with his attendance and proceed with the case.
