Prevention of Corruption Act, 1988–Secs. 7 & 13(1)(d) r/w. 13(2)–Establishment of offence–Recovery of Rs. 10,000/- during the proceedings of trap was made from the appellant–Demand and motive were also proved–Tape recording of the pre trap and trap proceedings and telephonic conversations fortify and demand–Impugned judgment of conviction of S does not suffer from any illegality or infirmity–However, fact that L was acting as a conduit of accused S is not proved by the evidence–His conviction deserves to be quashed and set aside.
