Penal Code, 1860–Sec. 302/34–Conviction–Sustainable against whom–Two accused–Deceased sustained 24 injuries including several incised stab wounds–Deceased was thrown from the car after committing murder–Bloodstained knife, clothes of accused and currency notes were recovered at the instance of accuseds S–Same blood group was found on these all articles–Eye witness specially named the accused S–Held, he was rightly convicted by trial Court–Accused P was not named in FIR and he was not identified by eye witness during the investigation–Mere recovery of the car and having blood stains on it is not sufficient ground for recording his conviction–Recovery of currency notes also not established against him–Held, he is entitled to be acquitted.
