Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 8(c) r/w. 20(b)(ii)(c)–Conviction–Sustainability–Recovery of 600 kgs. dry ganja–During the intervening period of recovery and production before the Court for first time, the contraband remained in the custody of the Investigation Officer–It was kept in a separate room in his office without being sealed properly–Possibility of tempering during this fifteen day’s period cannot be totally ruled out–Neither there was compliance of the Standing Order nor the departure was justified–Non-compliance of provisions of Sec. 52-A due to lack of experience of the Investigation Officer–Appellant is entitled to get the benefit of doubt.
