Rajasthan Co-operative Societies Act, 2001–Secs. 28(13), 58 & 104–Disqualification from the membership for not fulfilling the conditions–Under challenge–Grounds of the petitioner that the powers u/s. 58 could not have been invoked–Acceptability–By virtue of the latest Notification, power of Registrar is now conferred on the Deputy Registrar–Dispute is relating to the disqualification of membership, therefore, the Deputy Registrar cannot be said to be lacking the jurisdiction to adjudicate any question to disqualification–Remedy of appeal lies before the Registrar u/s. 104 of the Act–Petitioner has an efficacious alternative remedy–Interference declined.
