Motor Vehicles Act, 1988–Sec. 147–Liability of Insurance Company–Vehicle in question was insured with “Liability Only Policy”–No premium was paid to cover the driver, owner or a gratuitous passenger travelling therein–Deceased was a gratuitous passenger–Held, Court below ought to have directed the Insurance Company to indemnify the amount and thereafter, recover the same–Directed accordingly.
